As you know DOE requires all agencies and their sub-contractors to carry this insurance.  NYSWDA has obtained a quote that gives agencies sub-contractors the ability to obtain this coverage at the same price as the agencies. 

NOTE: Sub-Contractors are required to follow NY's Lead Safe Weatherization Practices and have their staff certified by attending the 1-day DOE Approved Lead Safe Weatherization Course.  NYSWDA will be providing this training on an ongoing schedule.

Coverage

NYSWDA & BC Environmental Insurance offers a pollution policy excluding mold with $500,000 limits and a $2,500 deductible.  The policy is claims-made which means the policy will have a retro-active date.  Work after the retro-active date will be insured.  For future renewals going forward, the retro-active date should not change even if insurance companies do.

Underwriting

The weatherization application should be completed to the best of your understanding.  The application is orientated towards local agencies but applies to private contractors as well.  The documents required at the time of binding are:

  1. Company specific work procedures for covered service(s) (Lead Safe Weatherization Work Practices)
  2. Current Financial statement
  3. Currently valued insurance company prepared loss runs for the last four most recent years (only if previous Pollution coverage was in force)

The “lead safe weatherization work practices” training source material will be kept on file with the brokerage for the State of New York.  Private contractors need to provide certification of "Lead Safe Weatherization Work Practices" training.

Professional Coverage/Local Agencies

Local agencies that utilize private contractors for the weatherization in-house work but provide “oversight” or “project management” to the private contractor can purchase either incidental professional liability endorsement or full professional liability coverage.  Minimum premiums would be $3,200 to $4,000.  An application other than the weatherization application would be required.  Please request from BC Environmental Insurance Brokers, Inc. at wap@environmentalinsurance.com.
